Terms and Conditions for PJT Powersport Repair

Definitions:
"PJT Powersport Repair" refers to the entity providing repair and custom build services for off-road vehicles. "Customer" signifies an individual or entity seeking these services.

 

Service Scope:
PJT Powersport Repair offers a comprehensive range of powersport vehicle repair and maintenance services. This includes general repairs, electrical solutions, suspension adjustments, fuel system work, engine maintenance, performance engine builds, race setups for ATVs and dirt bikes, ground-up builds, restorations, and custom constructions.

 

1. Payment Methods:

Payments are accepted via Cash, PayPal, Venmo, Certified Cashier's Check, or Certified Bank Check made payable to PJT Powersport Repair. No personal checks or other unlisted methods will be accepted unless agreed upon in advance.

 

2. Deposit and Payment:

A 50% deposit of the estimated cost is required before the commencement of any work. The balance must be settled within seven (7) business days post-completion. Late payments will be subject to a $25 daily fee. After 30 days, a cumulative fee of $75 per day will apply, inclusive of a $50 per day storage fee.

 

3. Non-payment and Remedies:

If no payment is made within three (3) months, PJT Powersport Repair reserves the right to either deposit the vehicle at the state police facility or sell the vehicle/components to recover the owed amount, provided the debt exceeds $500.

 

4. Quotes & Estimates:

Quotes or estimates are grounded on initial inspections. Actual costs may vary based on the precise work required or any additional parts deemed necessary during the service process.

 

5. Cancellation and Refunds Policy:

For canceled services where work has commenced, charges will include labor, restocking fees, shipping for returns, shop supplies used, and a discretionary $85 cancellation fee. No refunds, returns or exchanges are permitted on anything provided by PJT Powersports Repair. However, in unique circumstances, PJT Powersport Repair may offer labor discounts to compensate.

 

6. Warranty & Parts:

PJT Powersport Repair offers no warranties on any completed work or parts, whether sourced by the customer or PJT Powersport Repair. While customers may provide their parts, if deemed a safety hazard, PJT Powersport Repair retains the right of non-installation. It is preferred, for efficiency, that parts are sourced through PJT Powersport Repair.

 

7. Third-party Services:

PJT Powersport Repair may utilize third-party providers for specific services, notably for machining engine components, powder coating, and procuring parts. While we will assist in resolving any issues caused by these third parties, we are not responsible for their errors or faults.

 

8. Communication:

Communication can range from emails, phone calls, to text messages, depending on the customer's choice.

 

9. Data Protection:

All customer data is confidential. It is exclusively used for service-related communication and will never be sold or distributed to third parties.

 

10. Force Majeure:

Neither party is liable for any failure of or delay in the performance of this agreement due to causes beyond its reasonable control, including acts of God, war, strikes, or labor disputes, embargoes, government orders, or any other force majeure event.

 

11. Errors and Omissions:

PJT Powersports Repair makes every effort to provide accurate and high-quality services to our clients. However, in the event that an inadvertent error or omission occurs in our service or any documentation provided, we are not liable for any resulting damages or losses.

 

12. Potential for Unforeseen Issues:

Even with thorough diagnostics and repairs, there's always the possibility of other, less obvious issues coming to light once the major known problems are fixed. This is true for both newer or older vehicles with unknown history, where wear and tear can be widespread. PJT Powersport Repair employs comprehensive diagnostic and repair techniques to identify and resolve known issues with each vehicle. However, due to the intricate nature of powersport vehicles, there is always a possibility that additional, less apparent problems may emerge after the initial major issues are addressed. PJT Powersport Repair commits to communicating any such unforeseen issues promptly and transparently to our customers, along with a detailed assessment and recommendations for any additional repairs that may be necessary.

 

13. Limitation of Liability:

PJT Powersports Repair will not be held responsible for any errors or faults in the installation of parts, nor for the quality of parts used in repair or modification services. Moreover, PJT Powersports Repair shall not be held accountable for any harm, whether physical or otherwise, that may come to any person due to the use or operation of repaired or modified vehicles.

 

14. Acknowledgment of Risk:

Modifying any vehicle inherently comes with risks, including but not limited to, reduced reliability and an increased chance of injury or death. Customers acknowledge these risks when choosing to engage in modification services.

 

15. Governing Law:

All terms and conditions are governed and construed by Illinois law.

 

16. Dispute Resolution:

Disputes will first be addressed through mediation, followed by arbitration if mediation proves unsuccessful. If arbitration doesn't yield a resolution, the matter will proceed to court.

 

17. Terms Amendment & Publication:

The latest terms will be accessible at www.pjtpowersports.com. If terms are revised during an active work order, the pre-existing terms remain effective until work completion.

 

18. Vehicle Presentation:

Vehicles should be presented clean. A cleaning fee will be charged for vehicles deemed unclean. Customers are advised to remove valuables and any excess items from their keychains or from their vehicle prior to dropping off for service.

 

19. Damage or Theft:

PJT Powersport Repair is not liable for theft or damage inflicted on the customer's vehicle due to vandalism, human actions, natural events, or disasters.

 

20. Promotions and Discounts:

Any promotions or discounts are one-time use only and expire on the given expiration date.

 

21. Shipping:

PJT Powersport Repair ships via UPS, USPS, and FedEx, with UPS as the preferred carrier. Customers can choose from overnight to 8-business-day shipping. PJT Powersport Repair is not responsible for lost or damaged packages, although every precaution, including purchasing insurance and secure packaging, will be taken.

 

22. Returns and Exchanges:

No returns or exchanges are permitted except under exceptional circumstances, which will be solely at PJT Powersport Repair's discretion.

 

23. Termination of Services:

PJT Powersport Repair reserves the right to discontinue services and request compensation for work already completed in instances where the customer is uncooperative, unreasonable, or poses a threat or burden to PJT Powersport Repair, its employees, or third-party vendors.

 

24. Severability:

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.

 

25. Agreement:

By engaging with PJT Powersport Repair, customers indicate acceptance of these terms, whether signed or not. Familiarity and agreement with these terms are the customer's responsibility.
